Welcome to Tuvy!
These Terms and Conditions ("Terms") apply to your access and use of the Tuvy website, mobile application, and related services (the "Platform"). By creating an account, using a guest checkout, or booking a service through Tuvy, you agree to these Terms.
If you do not agree to these Terms, please do not use the Platform.
Tuvy is a digital booking marketplace. We provide the software that allows you (the "Client") to discover, book, and pay for local services, classes, and events provided by independent third-party businesses and professionals (the "Vendors").
We are the platform, not the provider: Tuvy does not provide the haircuts, tutoring, fitness classes, cleaning, or any other services listed on the Platform.
Your Contract is with the Vendor: When you make a booking, your legal contract for that service is directly with the Vendor. Tuvy is simply acting as a software facilitator to help you connect and transact.
No Endorsement & Trust Badges: Tuvy does not endorse, conduct formal criminal background checks on, or guarantee the quality or safety of any Vendor. We use a trust badging system to help provide transparency, but you acknowledge that these badges have strict limitations:
These badges do not act as a legally binding guarantee of a Vendor's ongoing professional qualifications, business conduct, or service quality. You book and engage with all Vendors entirely at your own risk.
Accurate Information: Whether you sign up for a Tuvy account (via email or Facebook) or use Guest Checkout, you must provide accurate, current, and complete information (including your name and contact details) so the Vendor can fulfill your booking.
Account Security: You are responsible for keeping your password secure. Tuvy is not liable for any unauthorized bookings made using your account.
Age Requirements: You must be at least 18 years old to create an account. If you are booking a service for a child (e.g., kids' tutoring or dance classes), you confirm you are their parent or legal guardian and have the authority to book on their behalf.
Vendor Policies: Every Vendor on Tuvy runs their own independent business. When you book a service, you agree to be bound by that specific Vendor's cancellation, rescheduling, and no-show policies.
Cancellations: If you need to cancel or reschedule, you must do so within the timeframe allowed by the Vendor. If you cancel late or fail to show up ("no-show"), the Vendor reserves the right to charge a cancellation fee or retain your deposit/full payment, as per their policy.
Recurring Bookings: If you opt into a recurring booking (e.g., a weekly cleaning service or 10-week tutoring term), you agree to be billed for those ongoing services according to the schedule you selected, until you or the Vendor cancels the series.
Direct Payments: Tuvy uses secure third-party payment gateways (such as Stripe and Worldline) to process your payments. When you pay for a service online, your funds are securely routed directly to the Vendor's merchant account. Tuvy does not hold your funds.
Payment Surcharges: Some Vendors may choose to pass on credit card processing fees. If a Vendor applies a payment surcharge, this will be clearly displayed in your Booking Summary before you confirm your payment.
"From" Pricing & Estimates: Some services (like home cleaning or auto repair) may display a "From" price. You acknowledge that this is an estimate. The Vendor will confirm the final price with you upon assessing the job, and final payment may be required directly at the venue.
Because Tuvy is not the provider of the services, Tuvy cannot issue refunds on behalf of a Vendor. If you are unhappy with a service, or if a Vendor cancels your booking and owes you a refund, you must contact the Vendor directly to resolve the issue.
The Vendor is solely responsible for processing refunds in accordance with their own business policies and New Zealand consumer law.
Tuvy is not responsible or liable for resolving disputes between Clients and Vendors, though we reserve the right to remove Vendors from the Platform if they consistently violate our community standards.
Fraud and Chargebacks: Because payments are routed directly to the Vendor's merchant account, if you suspect a Vendor has acted fraudulently or failed to deliver a service, your primary financial recourse is to dispute the charge directly with your bank or credit card provider. Tuvy cannot refund money that is held by a Vendor.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA) or the Fair Trading Act 1986 (FTA).
Tuvy's Guarantee: We guarantee that our software platform will be provided with reasonable care and skill.
Vendor's Guarantee: The Vendor is legally responsible for ensuring that the actual physical service (e.g., the haircut, the plumbing repair) meets the guarantees of the CGA (e.g., that it is fit for purpose and carried out with reasonable care and skill).
To the maximum extent permitted by New Zealand law, Tuvy (and our directors, employees, and agents) will not be liable for:

Vendors reserve the right to refuse service to any Client who behaves inappropriately or poses a safety risk.
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information, including how we share your contact details with the specific Vendors you choose to book with.
We may update these Terms from time to time as our Platform grows. If we make significant changes, we will notify you via email or through an alert on the Platform. Your continued use of Tuvy after changes are published constitutes your acceptance of the updated Terms.
